Hey Guys, I am here in Sajha with a Tax Question. I am on F1 and filing 1040NR. My spouse is also in US on F2 dependent visa. I want to get a credit for my spouse and ITIN as he is not legally allowed to work and is a dependent. But it seems like Non resident from Nepal Can not claim an exemption for spouse as a depedent as per Instruction book. IS it so? Please suggest. Thanks in advance.

Yes, you're correct. You cannot claim your spouse as dependent if you are a F-1 Student. All you can deduct is the tax paid to the State as Itamized deduction and you get personal exemption for $3200. You got to pay the tax on rest of your earning.

hello aabha,
I know it gets confusing with the filing taxes. If you spouse and you have a SS# then you can simply file 1040. Don't worry about 1040NR. We are as confused as the IRS are.
You can claim your spouse as dependent in 1040.

Obrian, Only I have social security number. and purush, I understand, your suggestion is right but I am already having with held almost 10% of my earning and from tax table calculatin it seems like I still owe another 5% that is around $1000 to IRS.To claim deductions I do not have any proof of receipts. If I can claim for spouse it might give some relief.

You can deduct state tax because your W-2 has the amount of your state tax with-holding. You don't need a second proof for that when you attach your W-2. You can not claim any other deductions if you are filing as F-1.
If you file as US resident you can deduct $5000 as standard deduction without a proof, and personal exemptions for your spouse as well. If you mind legality, you got to go with the F-1 filing.
